In 2003, Jan founded Bernstein & Associates to help those with standing and those that must comply implement NAGPRA. She has been facilitating repatriation since 1984 and has 20 years of experience managing archaeology, ethnographic, and natural history collections.

Since the passage of NAGPRA, Jan has worked with Indian Tribes throughout the country, Native Hawaiian organizations, Alaska Native Villages, museums, universities and colleges, municipalities, and state and federal agencies on all aspects of NAGPRA implementation. Those projects resulted in the repatriation of the remains of thousands of ancestors and cultural items.

Jan is on the faculty of the National Preservation Institute and is an instructor for the National NAGPRA Program.​ She holds a B.A. in Art and Art History from California State University Sacramento and an M.S. in Museum and Field Studies from the University of Colorado, Boulder.
